1. Definitions

• « Company, » « we, » « our » — FJCode OÜ, the owner and operator of the SkinAI Service.
• « User, » « you » — any individual or legal entity using the Service.
• « Service, » « Application » — SkinAI mobile applications (iOS/Android), the websites skinai.pro and skinailab.com, and other digital products and tools managed by the Company.
• « Content » — any information, materials, text, images, photos, videos, audio uploaded or generated by Users while using the Service.
• « Third-party services » — any third-party platforms, resources, and products that may be integrated or linked to the Service.

2. General Provisions

1. This Agreement constitutes a legally binding contract between you and the Company. By registering in the Application or using the Service, you confirm your acceptance of these terms.
2. The Company reserves the right to make changes to this Agreement at any time. The updated version will be published on the website and/or in the Application with the date of the last update. In the event of significant changes, the Company will make reasonable efforts to notify Users (via email or otherwise). By continuing to use the Service after the publication of changes, you confirm your agreement to the new terms.
3. Other documents may apply in addition to this Agreement: the Privacy Policy, License Agreements, user guides, etc. In case of any contradictions, the provisions of this Agreement take precedence.

3. Use of the Service and Restrictions

1. Age restriction: The Service is intended for users over 18 years of age. We do not knowingly process data of individuals under 18 without parental or guardian consent.
2. Purpose of the Service: SkinAI provides functionality for analyzing skin images using artificial intelligence algorithms. The results obtained are not a medical diagnosis and do not replace a consultation with a dermatologist.
3. Limitation of liability: The Company is not responsible for users’ decisions based on the results provided by the Service. For any suspicion of skin conditions, consult a doctor immediately.
4. Legality of use: By using the Service, you confirm that you have all the necessary rights and authority and that you comply with applicable laws.
5. No abuse: The User agrees not to interfere with the Service, not to decompile or modify its source code, not to use automatic scanners, not to distribute malware or spam, etc. Violations may result in account blocking and/or legal action.

Important: The analysis may be less accurate or not recommended in the following cases:
(i) Fitzpatrick skin type V or VI (dark skin tones),
(ii) skin areas with tattoos, makeup, or artificial modifications,
(iii) damaged, inflamed, or non-intact skin (e.g. open wounds, burns).

4. Registration and Account

1. Registration may be required to access all features of the Service. The User agrees to provide accurate and up-to-date information (e.g., email, name, age, skin tone, etc.).
2. The User is responsible for maintaining the confidentiality of their account data (login/password) and for all actions taken under that account.
3. In case of password loss or unauthorized access, the User must immediately notify the Company by contacting support.

5. Paid Services and Payment

1. Some features of the Service may be provided on a paid basis (subscriptions, individual packages). Information about pricing and rates is available in the SkinAI app on Apple Store and Google Play, or on the websites skinai.pro and skinailab.com.
2. Payment may be processed via Apple Store and Google Play services or third-party payment systems contracted by the Company. The Company does not store sensitive payment data on its servers.
3. Refunds, subscription renewals, and other terms are described in the relevant Subscription Terms and comply with the Apple Store and Google Play policies. Please review them before making a purchase.
4. You may cancel your subscription at any time through the platform where the subscription was purchased. In case of cancellation, access remains until the end of the billing period. Refunds are only issued in cases defined by the respective app store policy or applicable laws.

6. Content Rights

1. User content: By uploading images and other information to the Service, the User retains all rights to that content but grants the Company a limited license to use it (e.g., store, display, process) to provide services within the Service.
2. The Company may use anonymized (de-identified) data for research, algorithm improvement, and statistical purposes. See details in our Privacy Policy.
3. Company intellectual property: All materials, software, algorithms, and branded elements published on the website and in the Application belong to the Company or its licensors and are protected by copyright and intellectual property laws.

7. Privacy Policy

The personal data we collect (including skin images, contact information, device data, usage statistics) is processed according to our
Privacy Policy.

The collected data may be used to:
(i) provide and personalize the Service,
(ii) analyze usage and improve AI algorithms,
(iii) ensure compliance with legal obligations.

Under the GDPR, users have the right to:

• access their personal data,
• request deletion (“right to be forgotten”),
• request data export (portability),
• withdraw consent at any time.

Your data is stored securely and processed only for as long as necessary to fulfill the purposes outlined above.

8. Disclaimer and Limitation of Liability

• The Service is provided « as is » and « as available, » without any express or implied warranties. The Company does not guarantee error-free operation, uninterrupted access, or that the Service will meet user expectations.
• The Company is not liable for any indirect, incidental, or punitive damages resulting from the use (or inability to use) the Service, even if it was advised of the possibility of such damages.
• To the extent permitted by law, the Company’s total liability does not exceed the amount paid by the User for paid services within the last six months.

9. Links to Third-Party Sites and Services

The Service may contain links to third-party resources (websites, apps). The Company does not control and is not responsible for the content and privacy practices of such resources. We recommend reviewing their own terms and policies.

10. Modification and Termination of Service

• The Company has the right to modify features or discontinue support for individual functions or the entire Service at any time without prior notice to Users.
• The Company is not responsible for any losses incurred by the User due to such changes or discontinuation of services.

11. Governing Law and Dispute Resolution

1. This Agreement is governed by the laws of Estonia, unless otherwise specified by local laws in the User’s region.
2. All disputes arising in connection with this Agreement, if not resolved through negotiations, shall be resolved in the courts of the Company’s place of registration, unless otherwise provided by mandatory legal norms.

12. Miscellaneous

1. If any provision of this Agreement is found to be invalid or unenforceable, it shall not affect the validity of the remaining provisions.
2. The Company’s waiver of any provision or condition of this Agreement shall not constitute a permanent waiver.
3. You agree not to assign or transfer your rights and obligations under this Agreement to any third party without the Company’s written consent.

13. Limitations of Use and Disclaimers

1. The SkinAI Service is not a medical device and does not provide medical diagnosis, treatment, or prescriptions. All results generated are for informational purposes only and must not be interpreted as professional medical advice.
2. Always consult a qualified healthcare provider if you have concerns regarding your skin condition or require diagnosis and treatment.
3. Any action taken based on results from the Service is done at your own discretion and risk.
